By accessing or using Pesaflow's payment processing platform, APIs, dashboards, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Description of Services

Pesaflow provides a payment processing platform that enables businesses to accept payments through multiple channels including mobile money (M-Pesa, Airtel Money), bank transfers, and card payments. Our Services include payment gateway integration, transaction management, merchant dashboards, settlement processing, and related financial technology solutions.

3. Account Registration

To use our Services, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your registration information is current and accurate

4. Merchant Obligations

As a merchant using Pesaflow, you agree to:

• Complete the Know Your Customer (KYC) verification process
• Comply with all applicable laws and regulations
• Not use the Services for illegal or prohibited activities
• Maintain accurate records of transactions processed through our platform
• Provide timely refunds to customers when applicable

5. Payment Processing

Pesaflow processes payments on behalf of merchants. All transactions are subject to our fraud detection and risk management systems. We reserve the right to hold, delay, or refuse any transaction that we reasonably believe may be fraudulent, illegal, or in violation of these terms. Settlement timelines and fees are as agreed in your merchant agreement.

6. Fees and Charges

Transaction fees, settlement fees, and any other applicable charges will be communicated to you during the onboarding process and detailed in your merchant agreement. Pesaflow reserves the right to modify fee structures with 30 days advance notice. Continued use of the Services after fee changes constitutes acceptance of the new terms.

7. Intellectual Property

All content, trademarks, APIs, documentation, and technology provided through Pesaflow are the property of Pesaflow or its licensors. You are granted a limited, non-exclusive, non-transferable license to use our Services in accordance with these terms.

8. Limitation of Liability

To the maximum extent permitted by law, Pesaflow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

9. Termination

Either party may terminate this agreement with 30 days written notice. Pesaflow may immediately suspend or terminate your access if you violate these terms or if required by law. Upon termination, any pending settlements will be processed according to the standard settlement schedule.
